Things to Keep in Mind

While the 870 visa offers many benefits, it is important to be aware of its limitations:

  • No work rights – Holders cannot undertake paid work in Australia
  • No pathway to permanent residence – You cannot apply for a permanent parent visa while holding an 870 visa (although you can apply and hold an 870 visa after you’ve lodged an offshore permanent parent visa)
  • Mandatory time offshore for renewals – In most cases, you must spend at least 90 days outside Australia before re-applying for a subsequent 870 visa
  • 10-year cap – The visa can only be held for a maximum of 10 years cumulatively. After this, parents must either depart Australia or apply for a different visa.
