Prospective Marriage visa (subclass 300)

The Prospective Marriage visa (subclass 300) is for people who want to come to Australia to marry their prospective spouse. An applicant for this visa must have personally known and met with the Australian sponsor physically, and be engaged to be married soon. The applicant must be sponsored by the Australian partner and marry the Australian sponsor in Australia within the visa period. They have to have intention to live together in a genuine spousal relationship after marriage and apply for the Partner visa 820/801 in Australia within the visa period.

Prospective Marriage visa is a temporary visa that lasts for nine months.

You must be outside Australia when you lodge your application and when the visa is granted. But you can have the wedding in any country, the wedding does not need to be in Australia.

Partner (Provisional) visa (subclass 309/820) and Partner (Migrant) visa (subclass 100/801)

The Partner (Provisional) visa (subclass 309) allows you to live in Australia if you are the spouse or de facto partner of an Australian citizen or a permanent resident or an eligible New Zealand citizen.

The Partner (Provisional) visa (subclass 309) is the first stage towards a permanent Partner visa (subclass 100). The Partner provisional visa subclass 820 is also the first stage of an onshore Partner visa toward a permanent visa 801.You lodge only one application for your temporary and permanent visas and pay one application charge. Your application is processed in two stages, about two years apart.

All applications for Partner visas have to be supported by evidence of their genuineness, as well as statutory declaration from friends and relatives stating their views on the likely genuineness of the relationship. The applicant also needs to provide documents in relation to their financial aspects, nature of household, social aspects and commitment to each other.

You must be outside Australia when you apply for Partner visa 309 and also when the visa is granted. You can be in or outside Australia when Partner visa 100 is granted.

You must be inside Australia when you apply for partner visa 820. You can be in or outside Australia when Partner visa 801 is granted.

During the period of the temporary visa, applicants may live in Australia, can work and have access to Medicare and certain social security benefits.
